Conveyancing Certificates Conditions of use and Disclaimer
Before proceeding, please read and signify your agreement to the following terms and conditions.
In using this service you accept and understand that:-
- Your certificate will be created in an Adobe PDF format. Adobe Acrobat Reader is required to read the certificate which will be sent as an attachment to an email.
- Section 603 Rating Certificates will be delivered immediately.
- Section 10.7(formerly known as 149) Planning Certificates will be delivered by the close of the following business day (where delivery by email is selected and urgency fee has been paid).
- Other certificates may take up to 7 days to process.
- It is your responsibility to accurately identify (eg by reference to a lot and deposited plan) and verify (eg by reference to a contract, mortgage, survey or other relevant document) the identification of the land the subject of the certificate.
- Where delivery by email is selected or is otherwise the mode of delivery you are responsible for specifying the email address to which Lane Cove Council should send any certificate. Lane Cove Council does not verify whether certificates have been received without error or in the form in which they were sent.
- The eCertificates Service relies on the Internet to receive applications for certificates and to deliver certificates via email (where selected). Access to the Internet by users of the Service is dependent on numerous factors, technologies and systems, many of which are beyond Lane Cove Council's authority and control and Lane Cove Council will not be liable or responsible for:
- any inability of yours to access the Internet,
- emails not being delivered promptly, or at all, or
- certificates being or becoming corrupted or damaged in their passage across the Internet by reason of any factor beyond Lane Cove Council’s authority and control.
Lane Cove Council excludes any liability to you arising from or related in any way to:
- any act or omission of Lane Cove Council in good faith and without negligence;
- the failure of Lane Cove Council to receive any instructions, information or document by a particular time or at all unless the failure was the result of a negligent act or omission of Lane Cove Council; or
- any act or omission of a third party including, without limitation, a telecommunications or Internet service provider.
All matters relating to this service are governed by the laws of the State of New South Wales.
